These Terms of Service ("Terms") set out the conditions for using "DREAMAX" (the "Service"), an online language-learning service operated by DREAMAX Co. Ltd. (株式会社ドリマックス) ("we", "us", the "School"). By using the Service you agree to these Terms.
Article 1 (Scope)
These Terms govern the relationship between you and the School with respect to all use of the Service.
Article 2 (Accounts)
Using the Service requires signing in with a Google account. You must keep your registered information accurate and up to date.
Your account is for your personal use only and may not be shared, transferred, or lent. Except in cases of our willful misconduct or gross negligence, we are not liable for damage caused by inadequate management of your account.
Article 3 (Use by minors)
Minors may use the Service only with the consent of a parent or legal guardian.
Until guardian consent has been confirmed through the method we designate, minors cannot purchase paid plans or make any other payment.
Article 4 (The Service)
The Service is an online self-study platform including video lessons, vocabulary and kanji study, AI-assisted features such as reading and conversation practice, and mock exams. We may add to or change the contents of the Service without prior notice.
Article 5 (Fees and payment)
Fees for paid plans (monthly and annual) are displayed on the pricing page of the Service.
Payments are made by credit card through the payment processor Stripe. Card details are handled by Stripe; we never collect or store card numbers.
Subscriptions renew automatically at the end of each billing period and your registered payment method is charged, unless you cancel beforehand.
Article 6 (Cancellation and refunds)
You may cancel your subscription at any time. After cancellation, you can continue to use the Service until the end of the period you have already paid for.
Due to the nature of the Service, we do not provide refunds or pro-rated reimbursement for mid-period cancellation, except where required by law.
Article 7 (AI credits)
AI features (pronunciation assessment, AI feedback, AI conversation, etc.) consume credits granted according to your plan. Credits are capped; when your balance runs out, AI features are unavailable until a top-up purchase is completed.
Granted or purchased credits are non-refundable except where required by law.
Article 8 (Prohibited conduct / Acceptable use)
When using the Service, you must not engage in any of the following. These conduct rules apply to all users, including all input to the AI conversation, AI feedback, and other features:
- Violating laws or public order and morals
- Entering, sending, or causing the generation of sexual, violent, discriminatory, or otherwise vulgar or abusive content
- Copying, redistributing, recording, screen-capturing, or providing to third parties any content of the Service (videos, materials, questions, audio, etc.)
- Sharing, transferring, or lending your account
- Unauthorized access, reverse engineering, or interfering with the operation of the Service
- Defamation of, harassment of, or nuisance toward other users, teachers, or third parties
- Improper input to AI features (unnecessary personal information, abusive use, etc.)
Article 8-2 (Enforcement)
If we determine that you have breached the preceding article, we may take any necessary and reasonable measures, including a warning, interruption of the offending input or conversation, temporary feature restrictions, suspension of your account, or termination of your membership.
Because the Service is also used by minors, we respond especially strictly to sexual, violent, or abusive content. Where we judge it urgent, we may act without prior warning.
Article 9 (Intellectual property)
Copyright and other intellectual property rights in the content of the Service belong to the School or its rightful owners. You may use the content only to the extent necessary for your own personal study.
Article 10 (Disclaimers)
We do not guarantee learning outcomes or success in any examination.
AI-generated scoring, assessment, and feedback are provided as learning support; we do not guarantee their accuracy or completeness.
The Service may be interrupted due to system failure, maintenance, or network problems.
Except in cases of our willful misconduct or gross negligence, our total liability to you is capped at the total fees you paid to us in the 12 months preceding the event giving rise to the claim.
Article 11 (Changes, suspension, termination of the Service)
We may change or terminate all or part of the Service with prior notice. In urgent and unavoidable cases, we may suspend the Service without prior notice.
Article 12 (Withdrawal)
You may close your account at any time through the method we designate. Handling of personal data upon withdrawal follows our Privacy Policy.
Article 13 (Changes to these Terms)
We may amend these Terms when we judge it necessary. For material changes, we will give advance notice by appropriate means such as an in-service notice or email. Continued use of the Service after a change constitutes acceptance of the amended Terms.
Article 14 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan. The Osaka District Court has exclusive jurisdiction in the first instance over any dispute concerning the Service.
Article 15 (Language)
The Japanese text of these Terms is the official version. Where a translation is provided for reference and a discrepancy exists, the Japanese version prevails.
